7. Limitation of Liability for Denied Non-Compliance Issues

  • Regional Hood & Vent aims to ensure that all services rendered, including the inspection and cleaning of your kitchen exhaust system and associated equipment, adhere to the requirements of the NFPA 96 Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations and all other applicable regional safety codes. During the course of our service, we may identify maintenance, repair, or system design deficiencies (collectively, "Non-Compliance Issues") that pose fire or safety hazards and prevent full compliance with NFPA 96 or local fire codes.
  • Notification: We will formally notify the customer, of these Non-Compliance Issues in writing (e.g., service report, email, or formal letter).
  • Customer Denial: If the customer, after receiving formal notification, denies, delays, or refuses to authorize the necessary corrective services, repairs, or replacements to address the identified Non-Compliance Issues, the system will remain in a non-compliant state.
  • Limitation of Liability: In the event of any subsequent loss, damage, fire, injury, fine, or penalty related to or arising from the denied Non-Compliance Issues, the customer agrees that [Contractor/Company Name] shall not be held responsible or liable for any resulting damages, costs, or losses, including but not limited to property damage, business interruption, or legal expenses.
  • By denying the recommended corrective actions, the customer assumes all risk and liability associated with the continued operation of a non-compliant system. Our liability is strictly limited to the direct scope of the cleaning and maintenance services we were contracted and authorized to perform.

8. Disclaimer Regarding Coverage and Liability

  • Regional Hood & Vent maintains comprehensive General Liability insurance coverage, with limits including $2,000,000 in coverage, to protect our clients.Scope of Coverage:Please be advised that this insurance policy is specifically intended to cover damages or losses to property or persons that are directly and solely caused by the negligent actions or errors of Regional Hood & Vent employees while performing contracted services on your premises. Exclusions from Coverage: Our $2,000,000 liability coverage will not extend to, nor cover, any damages or losses that result from, or are related to:
  • Pre-Existing Conditions: Damage resulting from the pre-existing state of the kitchen equipment, exhaust system, building structure, or surrounding components (e.g., rust, corrosion, faulty installation by others, or wear and tear).
  • Customer Negligence/Non-Compliance: Damages arising from the customer's failure to maintain the system between scheduled cleanings or the customer's refusal to correct NFPA 96 non-compliance issues previously noted by our company.
  • Third-Party Actions: Damages caused by the actions, errors, or omissions of any party other than employees of Regional Hood & Vent (e.g., other vendors, employees of the customer, or independent contractors).
  • Our insurance serves as protection against our direct operational mistakes, not as a blanket policy for general facility issues or damages resulting from conditions outside the direct scope of our authorized service actions.
